In today’s increasingly complex business landscape, the intersection of law and management is more crucial than ever. As organizations operate under growing regulatory scrutiny, heightened ethical expectations, and evolving corporate responsibilities, the demand for legally literate business professionals continues to rise. This is where clinical legal education (CLE) proves transformative—not solely as a tool for law students, but as a dynamic pedagogical model that brings immense value to management education.
Originally designed to give law students hands-on experience with real legal issues, clinical legal education models have now expanded beyond legal studies to promote practical learning, critical analysis, and real-world problem-solving in other disciplines. Business schools are increasingly recognizing the power of CLE to improve decision-making across various managerial domains such as marketing, accounting, finance, and corporate strategy. When adapted for business contexts, CLE helps students comprehend the legal and regulatory ecosystems in which corporations operate and prepares them to anticipate legal challenges, uphold ethical standards, and make sound business judgments.
In this evolving approach, CLE doesn't just teach students about the law—it prepares students for practice, enabling them to apply legal reasoning in managerial scenarios. Whether it’s through simulation exercises, role-plays, or analysis of regulatory filings, CLE cultivates legal awareness and responsibility in future managers, particularly in areas where business activities are inseparable from legal compliance.
Marketing normally deals with creativity and strategic branding, yet it functions within a tightly regulated legal environment. The advertisement, digital campaign, and customer relationship must abide with different laws—from consumer protection act and advertising standards to intellectual property rights and data privacy regulations. This legal provision makes the application of clinical legal education models relevant in the Principles of Marketing subject.
A basic CLE activity is “Simulated Advertising Review Clinic”. In this simulation activity students act as legal representatives of real marketing campaigns. They examine the marketing content for misleading claims, missing disclosures, and violations of advertising regulations or consumer protection laws. By identifying such risks, they learn how to take decision which is both persuasive and legally sound. The next one can be “Workshops on Intellectual Property (IP) Rights”, here students identify brand protection cases, copyright problems and issues, and disputes of trademark. Moreover, Clinical method of learning becomes more effective when it’s evaluated by proper assessment. It can be assessed through project-based activity which make them work beyond the text book knowledge improvising their critical thinking and legal prudence.
Let’s see how we can use legal clinical education in accounting. In general accounting is defined as the bloodline of transparency, governance, and trust. Accounting department closely involves the legal dimension to analyse and take righteous decision as per law. The conflicts range from omissions, misstatements of financial data, manipulation of financial information leads to legal liabilities, which may range from fines and sanctions to criminal prosecution. Clinical Model education makes the task easy to handle such issues and financial disputes by integrating law and financial data and information.
The instructor can set up a simulation activity on Forensic Accounting wherein students are assigned the roles of auditors or investigators (forensic). Students are asked to refer and apply relevant laws to analyze financial frauds. They also deal with cases representing corporate fraud, insider trading, data privacy, financial statements fraud etc. Such activity gives hands on experience to understand the financial misconduct and also help to understand the different between technical errors and legal accountability.
The one another method is “Corporate Governance Clinics”. The students are asked to collect the freely available documents such as board meeting reports, MOAs, Audit reports, internal compliance policies to understand the duties and responsibilities of directors, board of members and auditors. Case studies like Enron or Wirecard (involving corporate scandals) illustrate the consequences of governance failures. The CLE model helps students to understand and learn why the legal safety is required to maintain governance and integrity of the company.
By delivering legal training through clinical legal education, accounting programs can cultivate a new generation of professionals who understand that integrity is not only an ethical choice but also a legal obligation.
