In this context, Clinical Legal Education (CLE) has emerged as a powerful tool to bridge the gap between legal theory and practice, especially when paired with the work of grassroots legal aid organizations and to prepare law students for real-world legal practice divorce, adoption, inheritance, and maintenance.

Relevance of Clinical Legal Education (CLE) in Family Law practice

Clinical Legal Education (CLE) in the context of family law practice broadly involves client counselling, legal drafting, court representation (under supervision) and community legal awareness programs. Additionally, CLE is especially impactful in family law, where legal issues often intersect with gender justice, child welfare, and social stigma related to concepts of divorce and adoption in India.

Legal aid organizations often help women navigate complex issues like dowry harassment, domestic violence, and custody battles. Under laws like the Hindu Marriage Act, 1955 and the Protection of Women from Domestic Violence Act, 2005, grassroots legal workers provide both legal and emotional support. Apart from this Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 also provides maintenance for women and children. Many women, especially in rural areas, are unaware of this right. Legal aid workers help file applications and represent them in family courts or Lok Adalats.

In many instances, legal aid organizations assist in ensuring that the adoption process is ethical, legal, and in the best interest of the child.

Grassroots Legal Aid in Action: India and Tamil Nadu

The Tamil Nadu State Legal Services Authority (TNSLSA) is a government-backed body that organizes Lok Adalats, legal literacy camps, and free legal aid clinics across Tamil Nadu. It plays a crucial role in resolving family disputes through mediation and conciliation. In 2024, TNSLSA conducted a series of legal awareness camps in rural districts like Villupuram and Theni, where women were educated about their rights under family law and assisted in filing maintenance and domestic violence cases.

The India Justice Foundation (IJF) based in Chennai, provides free legal aid to low-income individuals, especially in civil and family disputes. Their team of lawyers and paralegals work closely with women facing abandonment, divorce, or child custody issues. IJF recently helped a woman from a marginalized community in Chennai secure maintenance and custody of her children after being deserted by her husband. Additionally, there are organisations like Human Rights Advocacy and Research Foundation (HRF) focused on human rights and legal empowerment. It provides legal aid in family law matters, especially for Dalit women and children in conflict with the law. HRF’s “Legal Literacy for Women” campaign has reached over 10,000 women in Tamil Nadu, educating them about their rights in marriage, divorce, and inheritance.

Operating nationally, organizations like the Lawyers Collective offers legal aid and advocacy in family law, particularly in cases involving domestic violence and LGBTQ+ rights. Their work has influenced landmark judgments and policy reforms.

CLE and Legal Career Training in Law Schools

For students pursuing legal career training, these grassroots organizations offer invaluable field experience. Internships and volunteer work with these bodies allow students to understand the practical application of family law, develop client interaction skills, learn drafting and litigation techniques, understand the socio-economic context of legal issues and engage effectively in community outreach and legal literacy. This is especially beneficial for those seeking admission in law after graduation, as CLE provides a strong foundation for careers in litigation, public interest law, and policy advocacy.

Law schools and legal aid organizations need to strengthen partnerships with NGOs and family courts, offer specialized CLE modules in family law, encourage interdisciplinary collaboration with social work and psychology departments and significantly promote community-based legal education.
